Queensland's CTP (Compulsory Third Party) scheme is fault-based and regulated by the Motor Accident Insurance Commission (MAIC). Compensation is recovered against the at-fault driver's CTP insurer (Suncorp, Allianz, RACQ, QBE, or another approved CTP insurer). Unlike many other states, Queensland has no statutory cap on common-law damages, meaning successful claims can recover the full reasonable value of the loss.
Queensland CTP settlements typically range from $50,000 for minor whiplash injuries with quick recovery, to $250,000 for moderate orthopaedic and soft-tissue injuries, to $500,000+ for serious injuries with permanent impairment and reduced earning capacity. Catastrophic injury matters often combine with NIISQ lifetime support and can result in multi-million dollar packages over the claimant's lifetime.
QLD CTP claims follow the Personal Injuries Proceedings Act 2002 (PIPA) process: serve a Notice of Accident Claim Form, the insurer responds within 6 months, exchange information and medical evidence, attend a Compulsory Conference (a structured settlement negotiation), and proceed to court only if no settlement is reached. Most claims settle at or before the Compulsory Conference.
