Queensland CTP, explained
Queensland's CTP (Compulsory Third Party) scheme is fault-based and regulated by the Motor Accident Insurance Commission (MAIC). Compensation is recovered against the at-fault driver's CTP insurer (Suncorp, Allianz, RACQ, QBE, or another approved CTP insurer). Unlike many other states, Queensland has no statutory cap on common-law damages, meaning successful claims can recover the full reasonable value of the loss.

The PIPA process
QLD CTP claims follow the Personal Injuries Proceedings Act 2002 (PIPA) process: serve a Notice of Accident Claim Form, the insurer responds within 6 months, exchange information and medical evidence, attend a Compulsory Conference (a structured settlement negotiation), and proceed to court only if no settlement is reached. Most claims settle at or before the Compulsory Conference.

How do I lodge a CTP claim in Queensland?
First, identify the at-fault vehicle's CTP insurer (use the MAIC enquiry line on 1300 302 568 or the rego lookup tool). Then complete a Notice of Accident Claim Form and serve it on the insurer. The insurer has 6 months to admit or deny liability. Most claimants engage a lawyer to handle this process; the lawyer's fees are typically deducted from the eventual settlement under no-win-no-fee terms.
How long do I have to lodge a QLD CTP claim?
Lodge the Notice of Accident Claim Form within 9 months of the accident date, or 1 month from the date you first consulted a lawyer about the claim, whichever is earlier. The 1-month rule is critical: once you see a lawyer, the clock starts. Late claims are accepted only with leave of court for compelling reasons.
Can I claim if I was partly at fault for the accident?
Yes, but your damages will be reduced by your percentage of contributory negligence. For example, if you were 25% responsible for the crash, your settlement is reduced by 25%. If you were entirely at fault, you cannot recover under the QLD CTP scheme (separate options may exist for catastrophic injuries via NIIS).
How long does a Queensland CTP claim take to settle?

What about catastrophic injuries in Queensland?
Catastrophic injuries (severe brain injury, high-level spinal cord injury, severe burns, multiple amputations, blindness) can be supported by the National Injury Insurance Scheme Queensland (NIISQ). NIISQ provides treatment, care and support for the rest of your life regardless of fault. CTP common-law damages may run alongside NIISQ for additional pain and suffering and lost earnings.
How are CTP legal costs handled in Queensland?
Most QLD CTP lawyers run on no-win-no-fee. If you win, costs are typically a mix of insurer-paid party-party costs plus solicitor-client costs deducted from your settlement. Queensland has caps under the Personal Injuries Proceedings Act on the total legal costs that can be deducted, designed to ensure most of any settlement reaches you.
