What if my claim has already been rejected?
Rejected claims can usually be reviewed and disputed. NSW has a free Independent Review Office (IRO) that funds legal advice for injured workers. Other states have similar review processes. How long do I have to make a claim?
Time limits vary by claim type and state. Motor accidents: typically 28 days for police report, 3–12 months for insurer claim, 3 years for common-law damages. Workers comp: usually 6 months for the formal claim, 3 years for common-law. Don't wait, early lodgement preserves backdated benefits and protects evidence quality. Late claims can sometimes still proceed, but it's harder.
