How do I lodge an ACT MAI claim?
Lodge through Access Canberra or directly with one of the licensed MAI insurers (NRMA, AAMI/Suncorp, GIO, APIA). The defined benefits process is quick: lodge an Application for Defined Benefits within 13 weeks for full backdated entitlements. The insurer must respond within set timeframes.
What are defined benefits under the ACT MAI Scheme?
Defined benefits cover anyone injured in an ACT motor accident regardless of fault: income replacement (capped weekly), reasonable medical and treatment expenses, attendant care for serious injuries, and quality of life payment for impairment. Defined benefits typically run for up to 5 years post-accident, depending on injury severity.
Can I pursue common-law damages in the ACT?
Yes, where you've been seriously injured by another driver's negligence and your injury meets the threshold under the Motor Accident Injuries Act 2019. Common-law damages can include past and future economic loss, future care, and pain and suffering on top of defined benefits.
How long do I have to lodge?
Defined benefits should be lodged within 13 weeks of the accident for full backdated entitlements. Common-law damages claims have a 3-year limitation period.
