Victorian WPI scheme overview

Victoria operates two parallel WPI assessment streams:

  • Workers compensation - assessed under the AMA Guides 4th edition (with WorkSafe modifications) for physical injuries, and GEPIC for psychiatric. Used for Impairment Benefits under the Workplace Injury Rehabilitation and Compensation Act 2013 (WIRC), and to support 'serious injury' determinations for common-law damages.
  • TAC (Transport Accident Commission) - assesses WPI under the Transport Accident Act 1986. Different rules, different thresholds, different benefit structures from workers comp.

AMA 4th edition (with VIC modifications)

Victoria is one of the few schemes still using the AMA Guides 4th edition (most schemes have moved to 5th or 6th). The 4th edition tends to produce slightly different ratings than 5th or 6th for the same injury - particularly for spinal and psychiatric impairments. WorkSafe has issued state-specific modifications further refining the methodology.

The assessment must be performed by an accredited Medical Panel assessor. Where ratings sit on a threshold, careful preparation - thorough treating doctor reports, range of motion measurements, neuropsychological testing - matters enormously.

"Serious injury" gateway and common-law damages

Victoria is unique in offering two paths to common-law damages:

Path 1: 30% WPI

If your WPI is 30% or higher (physical, or 30% psychiatric under GEPIC), you have automatic 'serious injury' status and can pursue common-law damages without further test.

Path 2: Narrative "serious injury" certificate

Below 30% WPI, you can still obtain a 'serious injury' certificate by satisfying a narrative test: the consequences of the injury must be 'severe'. The County Court (or Supreme Court for higher quantum) determines whether the threshold is met. Many serious injury certificates are issued for soft-tissue, psychiatric and chronic pain conditions where the WPI is below 30% but the functional impact is significant.

The narrative path is critically important - it preserves common-law access for many Victorian workers whose injuries don't translate to high WPI percentages but profoundly impact their lives.

Common-law damages once a serious injury certificate is held cover loss of earnings (past and future), medical expenses, care, pain and suffering. Settlements typically range from $200,000 to $1,500,000+ depending on injury severity and earnings.

TAC WPI assessment differs

TAC matters use separate methodology under the Transport Accident Act 1986. The TAC WPI threshold for Impairment Benefits is 11% (rather than workers comp's 10%). TAC also has its own 'serious injury' gateway for common-law damages, which works similarly to the workers comp gateway but with TAC-specific framing.
